TERMS AND CONDITIONS

These conditions govern all bookings made (whether through website, email, telephone or other means) with Italian Centre Apartments Limited ("ICA" "us "we") registered in Scotland under number SC294064 whose registered office is at Charles Oakley House, 125 West Regent Street, Glasgow. You accept these conditions yourself and on behalf of all members of your party (who shall be bound by these conditions) whether you are booking as a guest or on behalf of others.

1. Booking
Any booking made by you shall be deemed to be an offer by you to lease the relevant apartment on these terms and conditions. A contract between you and ICA shall be made upon (a) if booking by website or email and the requested apartment is available, once we confirm your booking by email or (b) if booking by telephone, confirmation by us of acceptance of your booking and payment details.

You shall to notify us at the time of booking of the names of the relevant guests and whether they are adults or minors.

Please check your details carefully before you book as incorrect or incomplete details may result in the booking being cancelled.

To confirm your booking we require a completed booking form or a completed booking link via the internet. Telephone bookings are confirmed only when we have accepted the booking in writing or email and have received payment in full.

Payment in full is required at the time of booking, unless otherwise agreed in writing. Should payment not reach us by the within the required time we reserve the right to suspend or cancel any bookings made and any deposit paid shall be forfeit.

Payment may be made by the following methods unless otherwise agreed by us:-

MasterCard
American Exdpress
Switch
Maestro

We may pass your debit/credit card details to a third party to process any payments.

Interest is payable on late payments at the rate of 4% above Bank England base rate from the due date until payment in full.

Passport, visa and health requirements for you and your party are your responsibility. You are advised to ensure that you arrange appropriate travel insurance policies etc cover cancellation, medical cover and loss or damage to personal property during your stay.

2. Prices and VAT
All apartment prices quoted are based on the prices prevailing at the time that a booking is confirmed. Once a booking has been confirmed we will not change the rate unless you amend the booking. Otherwise prices are subject to change without notice.
All amounts payable to us are deemed to be exclusive of Value Added tax which is payable in addition as if part of the price. This will impact from July 2007.

3. Deposit
A deposit must be paid at the time of booking. We may deduct from the deposit all amounts chargeable under these conditions, including, but not limited to, further accommodation charges, and an amount to cover breakages and damage of any kind to the apartment and any of the furniture, fabric and effects therein which occur during your stay. We will provide the booker with a breakdown of the issues and the applicable additional charges or other deductions from the deposit. Where additional charges are taken from the deposit the remainder of the deposit will be refunded to the person who paid the deposit at the end of the guest's stay after an inspection of the apartment occupied.

4. Additional Charges
Valid credit/debit card details must be supplied at the time of booking to cover additional charges incurred by you or your party, breakages and damages. We may deduct from the relevant credit/debit card, without further notice, all amounts chargeable under these conditions, including, but not limited to, further accommodation charges and any amount for breakages not covered by the deposit referred to above. Upon arrival at the apartment debit/credit card details may also be taken as security for any additional charges.
The additional charges include the cost of telephone calls, broadband access (where available).at the rates applicable at the time of your stay. These costs will be charged separately.

We will try to make the service is available at all times, cannot guarantee any internet or broadband connection availability. No support will be available if we determine that the unavailability of connection is caused by the user’s hardware or software.

5. Arrivals and Departures
Apartments are available for occupation from 4.00 pm on the day of arrival to 10:00 am on the day of departure unless otherwise agreed. Any additional hours of occupation outside the available times in each period of 24 hours will be charged as one extra day unless otherwise agreed.
Key collection details will be provided to the booker prior to the arrival date.

Where access codes are required to access the relevant apartment they and other relevant details will be provided only after booking is confirmed. It is the booker's responsibility to ensure that the guests have all the key, access codes and other relevant information.

6. Cancellations, Amendments and Extensions
We cannot guarantee that alterations which you wish to make to your booking will be met. These are subject to availability. You will pay the cost of any additional expenses incurred as a result of an alteration. We may charge, at its discretion, an amendment fee of up to £50 plus VAT to cover the necessary administrative costs incurred.

All cancellations must be confirmed in writing. Cancellation charges will be applied in accordance with the period between notification of cancellation and the date of stay at each apartment booked:

More than 6 days No charge

No refunds will be made where you do not take up your booking.

7. Restrictions
We operate a non smoking policy in our apartments. Dogs and other pets are not allowed unless with our prior written consent.

The number of people permitted to occupy each apartment is limited to the number of beds. In some apartments extra beds can be provided and this will be at a charge to be agreed at the time of booking. If the number of people permitted to occupy an apartment is exceeded, we may refuse access to the accommodation.

You and your party must comply with any rules and regulations set by us. Should guests be in breach of these conditions or our rules and regulations, we shall be entitled to remove guests from their apartment and to terminate our agreement with you.

8. Liability
Subject to terms of this paragraph , we shall not be liable in any manner or way for any indirect loss including but not limited to loss of profits, loss of business, loss of goods, loss of contract, loss of use, or any special, indirect, consequential or other economic loss, costs, damages, charges or expenses.

We shall not be liable for any failure or delay in performance of our obligations which result directly or indirectly from any cause or circumstance which is outwith our reasonable control including,act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, the act of any government or authority , fire, flood, lightning, explosion, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), strikes, lockouts or other labour dispute.

Renovations or other works may from time to time be undertaken at the property in which an apartment is situated. Whilst we will advise of such works where we are aware of them we will have no liability to you in connection with them. We shall have no liability for any failure or interruption of, services to the apartment or the building, in which the apartment is situated including but not limited to electricity, water, telephone, broadband, internet and other communications

Other than in relation to death or personal injury caused or materially contributed to by our negligence, or any other liability that by law cannot be excluded or restricted, our liability to you is limited to the price payable under the booking made with us. Nothing in these terms and conditions limits or excludes our liability for death or personal injury resulting from negligence; or for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation, or any liability that cannot by law be excluded.

All warranties, conditions and other terms implied by statute or common law or in any other manner or way are, to the fullest extent permitted by law, excluded from any contract with you and these conditions shall prevail. Nothing in these terms and conditions shall affect your statutory rights if you are a consumer.

9. Website
We do not warrant that any of the content of the ICA website and/or other means of promotion or advertising our services and apartments accurately or completely describe any of the apartments or the services that we provide. If photographs or plans are shown the apartment may vary from that depicted as may size, furniture and other fixtures and fittings and design.

10. Feedback and Complaints
If you are dissatisfied with our service, you should notify us in writing or by email as soon as possible. If your complaint is about the apartment, you should notify the apartment manager as soon as possible in the first instance. 11. General
These terms and conditions, together with any booking form or electronic booking information will form the whole agreement between us.

We may use your details to inform you of our products including special offers. All information collected or properly obtained during the booking process will be processed in accordance with our privacy policy which, with our web site use terms, are incorporated into these conditions.

We may change these conditions from time to time.

These terms and conditions are governed by the Law of Scotland and are subject to the non-exclusive jurisdiction of the Scottish Courts in respect of any claim, dispute or differer concerning these conditions and any matter arising from them.
